In these Terms and Conditions:

• "We", "Us", "Our", "Hang Loose Ibiza", or "the Company" refers to Hang Loose Ibiza, acting as an intermediary platform.
• "You", "Your", or "User" refers to the person accessing this website and/or booking services through it.
• "Service Providers" refers to third-party companies or individuals who provide the actual rental services (boats, vehicles, equipment) or activities.
• "Services" refers to any rental, activity, or other service offered through our website.

Hang Loose Ibiza acts primarily as an intermediary platform connecting Users with Service Providers. We facilitate bookings and payments but are not the direct provider of rental services or activities. The contract for the actual service is formed between you and the respective Service Provider.

When making a booking through our website:

• You must provide accurate and complete information.
• All bookings are subject to availability and confirmation.
• We reserve the right to refuse any booking for any reason.
• Payment terms and cancellation policies vary by activity and Service Provider, and are specified during the booking process.
• A binding contract between you and the Service Provider is formed once we send you a booking confirmation.

• All prices displayed on our website include applicable VAT and taxes.
• Payment methods accepted are specified during the checkout process.
• In some cases, a deposit may be required to secure your booking, with the balance due before the service date.
• We use secure payment processing systems, but cannot be held liable for any security breaches not directly attributable to our negligence.

In accordance with European Union consumer protection laws:

• For services to be provided on a specific date or within a specific period (such as boat rentals or activities on a particular date), the right of withdrawal provided for in Article 16(l) of Directive 2011/83/EU does not apply once the contract is fully performed.
• For other services, you may have the right to withdraw from the contract within 14 days without giving any reason.
• Our specific cancellation policies are:
• Cancellations more than 48 hours in advance: full refund
• Cancellations between 24 and 48 hours: 50% refund
• Cancellations less than 24 hours: no refund

We reserve the right to cancel bookings due to adverse weather conditions, safety concerns, or technical issues, in which case rescheduling or a full refund will be offered.

To rent a boat or other vehicle, the following are required:

• Valid ID or passport
• Valid navigation license (for boat rentals that require it)
• Valid driving license (for land vehicles)
• Security deposit (refundable upon returning the vehicle in good condition)

Service Providers may have additional requirements which will be communicated during the booking process.

When renting any vehicles or equipment, you agree to:

• Use it safely and responsibly, following all applicable maritime or traffic regulations
• Not exceed the maximum capacity of the vehicle/vessel
• Not sublet or lend the equipment to third parties
• Return the vehicle/equipment in the same condition it was received
• Immediately report any breakdown, damage, or accident
• Have all required documentation and licenses valid throughout the rental period

9.1 Our Liability:

• As an intermediary, our liability is limited to the proper processing of bookings and payments.
• We are not liable for the actions, omissions, or negligence of Service Providers.
• Our total liability to you for any claim arising from our services is limited to the amount paid by you for the booking in question.

9.2 Service Provider Liability:

• Service Providers are responsible for the proper provision of their services and compliance with all applicable regulations.
• Any claims related to the quality of service, accidents, or damages should be directed primarily to the Service Provider.

9.3 Force Majeure:

• Neither we nor the Service Providers shall be liable for any failure to perform due to causes beyond reasonable control, including but not limited to acts of God, war, terrorism, strikes, lockouts, industrial disputes, fire, flood, storm, or other natural disaster.

• All rentals include basic insurance as required by Spanish law.
• Details of insurance coverage are provided during the booking process.
• Additional insurance options may be available at extra cost.
• Insurance does not cover damage resulting from negligence, reckless behavior, or violation of maritime/traffic regulations.

All content on our website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and data compilations, is our property or that of our content suppliers and is protected by international copyright laws.

We process your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to such processing and warrant that all data provided by you is accurate.

In accordance with EU Regulation No. 524/2013, we inform you that the European Commission provides a platform for online dispute resolution (ODR) which can be accessed at https://ec.europa.eu/consumers/odr/. This platform serves as a point of entry for out-of-court resolutions of disputes arising from online sales or service contracts.

14.1 These terms and conditions are governed by the laws of Spain.

14.2 Any dispute arising in connection with these terms will be subject to the exclusive jurisdiction of the courts of Balearic Islands, Spain, without prejudice to the consumer's rights under applicable consumer protection laws to bring proceedings in their country of residence.

We reserve the right to modify these terms and conditions at any time. Such modifications will be effective immediately upon posting on the website. Your continued use of the website after such modifications constitutes your acceptance of the modified terms.
